Welcome to Progressive Learning Academy or PLA (www.thinkpla.com and www.thinkpla.ca). These Terms and Conditions (“Terms”) govern your use of our platform and services. By accessing or using our platform, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, please do not use our platform.

• “Services” refers to the services provided by PLA through www.thinkpla.com and www.thinkpla.ca.

3.1 Eligibility

4. Services

4.1 Tutoring Services

PLA offers various online-tutoring services, including but not limited to Comprehensive Tutoring, EXCEL Tutoring, French Tutoring, and ESL Tutoring. The details of these services, including session lengths and frequencies, are provided on our platform.

4.2 Payment and Subscription

• Users agree to pay all applicable fees for services as outlined during the purchase process.
• PLA may offer subscription-based services. Users agree to recurring billing according to the terms of the subscription. 

5. Content and Intellectual Property

5.1 User Content

Users may be able to submit, upload, or otherwise contribute content to the platform. Users retain ownership of their content but grant PLA a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content.

5.2 PLA Content

All content provided by PLA is the property of PLA or its licensors and is protected by intellectual property laws. Users may not use PLA content without prior written consent from PLA.

6. Privacy

PLA respects the privacy of its users. Our Privacy Policy outlines how we collect, use, and protect user information. By using our platform, users consent to the collection and use of their information as described in our Privacy Policy.

7. Limitation of Liability

To the fullest extent permitted by law, PLA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the platform;
• Any unauthorized access to or use of our servers and/or any personal information stored therein;
• Any interruption or cessation of transmission to or from the platform;
• Any bugs, viruses, Trojan horses, or the like that may be transmitted to or through the platform by any third party;
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the platform.

8. Indemnification

Users agree to indemnify and hold PLA, its affiliates, officers, agents, and employees, harmless from any claim or demand, including reasonable attorney’s fees, made by any third party due to or arising out of their use of the platform, violation of these Terms, or infringement of any intellectual property or other right of any person or entity.

9. Termination

PLA reserves the right to terminate or suspend access to our platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if users breach these Terms.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Canada and USA, without regard to its conflict of law provisions.

11. Changes to Terms

PLA reserves the right to modify or replace these Terms at any time. Users are responsible for reviewing these Terms periodically for any changes. Continued use of the platform after any such changes constitutes acceptance of the new Terms.
